Terms and conditions for users of the Bin Scout platform and services

1. Acceptance of Terms

By accessing or using the Bin Scout platform, requesting services, or maintaining an account with us, you agree to these Terms of Service.

2. Service Description

Bin Scout operates a platform that connects users with local independent service providers for bin placement, return, and related collection support services. Bin Scout facilitates bookings, communications, and payments, but the services themselves are provided by the relevant service provider.

3. Bin Scout Service Providers

Bin Scout service providers are independent contractors and are not employees, agents, partners, or joint venturers of Bin Scout. We do not control the manner or means by which they perform services, and they have no authority to bind Bin Scout.

4. User Responsibilities

As a user of the platform, you must:

  • provide accurate and complete information about your property, location, collection needs, and contact details;
  • ensure bins are safely accessible, ready for collection, and contain only permitted waste;
  • comply with local waste, recycling, and council requirements;
  • treat service providers and support staff respectfully;
  • promptly notify us of issues, incidents, access problems, or changes that may affect service delivery; and
  • maintain any insurance or property protections that are reasonably appropriate for services being performed at your premises.

5. Payment and Fees

Applicable fees will be disclosed at the time of booking, subscription selection, or account purchase flow. By completing a booking or subscribing, you authorise Bin Scout to collect amounts payable through the payment methods made available on the platform. You are responsible for any applicable taxes, chargebacks caused by your breach, and unpaid amounts lawfully owing for booked services.

6. Cancellation and Refunds

Unless otherwise stated at the time of booking:

  • you may cancel a scheduled service up to 24 hours before the scheduled collection time for a full refund;
  • cancellations within 24 hours may incur a cancellation fee or may be non-refundable where resources have already been committed;
  • if a booked service is not completed, your remedy may include a re-service, credit, or refund, as determined reasonably by Bin Scout based on the circumstances; and
  • refunds are processed back to the original payment method unless otherwise agreed.

7. Safety and Property Conditions

You must ensure that your property is reasonably safe for access by service providers. You must not request or permit any service involving unlawful, dangerous, or hazardous waste. You must report any incident, damage, injury, or safety concern to Bin Scout as soon as reasonably possible.

8. Prohibited Uses

You must not use the platform or services for:

  • illegal, prohibited, or hazardous waste disposal;
  • misleading, abusive, or threatening conduct;
  • circumventing Bin Scout's payment, booking, or safety processes; or
  • any unlawful purpose or any activity that creates a material risk to health, safety, property, or the platform.

9. Suspension and Termination

Bin Scout may suspend or terminate your account immediately where reasonably necessary to address unlawful conduct, fraud, non-payment, serious misuse of the platform, or a material risk to health or safety. For other breaches, where appropriate, we may give notice and an opportunity to remedy before terminating access.

10. Privacy

Your use of the platform is subject to our Privacy Policy. That policy explains how we collect, use, disclose, store, and protect your personal information.

11. No Warranties

To the maximum extent permitted by law, Bin Scout does not guarantee uninterrupted platform availability, error-free operation, or the availability of any particular provider at any particular time.

12. Limitation of Liability

To the maximum extent permitted by law, Bin Scout will not be liable for indirect, incidental, special, exemplary, or consequential loss. Where liability cannot be excluded, Bin Scout's aggregate liability will be limited to the total amount paid by you to Bin Scout for relevant services in the 12 months preceding the event giving rise to the claim.

13. Changes to These Terms

We may update these Terms of Service from time to time. Updated terms take effect when published on the website or platform unless a later date is specified.

14. Governing Law

These terms are governed by the laws of South Australia. The courts of South Australia will have non-exclusive jurisdiction in connection with any dispute arising from or relating to these terms, the platform, or the services.
